Dear Mr. Arader:
 
I have been publishing Audubon articles and Price Guides since 1999. My Recommended Audubon Dealers list first appeared in 2001, and you have been in the NOT RECOMMENDED category since that year. I'm surprised it has taken you this long to contact me. This list changes little from year to year. I remove some, such as when Bob Christmas died, or the demise of Haley & Steele. Occasionally, I run across a new dealer and do some business, and add them.
 
I'm not inclined to make any changes to your listing, or further discuss this matter. In one respect it is too late. Just two weeks ago I published The Audubon Price Guide Book with a chapter of my recommended Audubon dealers list.
It will also appear in my new CD-ROMs.
 
The book is also listed on my publisher's website, and they have begun a distribution and promotional program to the major book wholesalers, as well as major book retailers.
 
I can honestly say that over the years since 2001, I have probably talked to scores of people about you. Everyone who has commented about you and my recommended dealers list, says that you deserve to be NOT RECOMMENDED. In all that time, I cannot think of one person who has said anything good about you.

Have you ever seen my galleries in NYC (two,) Houston, Philadelphia, Denver, San Francisco or been to any of my booths at the antique shows we do.
 
Have you ever seen any of my inventory.
 
Have we ever done any business?
 
Kindly remember Mr. Flynn that I have put 7 people in prison for stealing maps from Libraries.  I have also made over one billion dollars in my business.  There are a lot of very jealous dealers because of this.  I have put their friends and sources in jail for as long as twelve years.
 
I also buy about 90% of all the good Audubons that come up at auction in New York City every year for the last 25 years and have an inventory of Audubons worth over $250,000,000.  This also makes dealers very unhappy because I am such a large part of the market.
 
I can understand that these dealers are you friends and that you are trying to help them out.  But your actions are damaging me in a very serious way.
 
I would like to see if you and I can work something out so that you can base you allegations on first hand fact rather than from jealous friends.
 
I would be delighted to pay for you to visit my galleries in NYC at anytime that might be convenient for you.
 
Please try to work with me.

I'm sorry, but you could not be more wrong in your conclusions. Fortunately, in this Country people are still entitled to their opinions. That is what this is, my opinion and free speech. Nothing libelous was published.

You have been given a chance to see if there was some way that we could work something out without resorting to using lawyers.  It has been my experience that once past this stage costs can spiral when a perfectly reasonable settlement could have been made without this overwhelming expense for either of us.
 
It is my intention to explore the validity of your conclusion based on the fact that you have never met me or given me a chance to refute your opinion that is being widely read by many potential clients.

Mr. Arader thinks that the other Audubon dealers are unhappy and jealous of him. He seems to think that I am somehow conspiring to help other Audubon dealers, and not him. He makes other boastful claims. Would you do business with a guy like this? I wouldn't.

Dear Mr. Flynn:

I represent W. Graham Arader, III and Arader Galleries. I am contacting you in hopes that we can avoid litigation over false and defamatory statements you have made on your website (www.auduboninfo.net).

There, you have identified Audubon print dealers whom you recommend and whom you do not
recommend. Among those "not recommended" are my clients. You state: "I have had personal
experiences with the following dealers and cannot recommend them. I do recommend that you travel to these galleries to actually see what you are buying. I have nothing else to say. Caveat emptor!"

This accuses my clients of behaving unethically and even criminally by misrepresenting what they sell
to buyers. Such accusations are wholly false. Indeed, Mr. Arader has had no "personal experiences" with you, nor has he misrepresented what he sells to you or anyone else. And these false and defamatory accusations are causing ongoing harm to my clients' reputations and business.

I demand that you immediately take down any and all references to my clients on your website. If you do not do so, I will take all necessary steps to compel you to do so.

Dear Mr. Flynn:

I am following up my letter to you dated February 5, 2008 regarding the false and defamatory statements you have made on your website (www.auduboninfo.net). In a subsequent email to me, you promised that you would respond to the letter by February 19, 2008. I received your response on February 25. 2008.

Your letter spends a lot of time ignoring my clients' complaints. just as your emails to Mr. Arader
simply brushed off Mr. Arader's good faith efforts to resolve this matter. On your website and now in your new book (and no doubt elsewhere), you accuse my client of behaving unethically and
inappropriately. You now admit that you have had no dealings whatsoever with Mr. Arader and that your charges against my client are based on rumor and gossip. You claim that this is your "opinion" as though there is some privilege under the law for "opinion." There is not. You claim that your ongoing libels are protected by the statute of limitations. I suggest you get a lawyer.

What is more. I checked your website and see that you have made revisions that are wholly inadequate and fail to address my clients' serious concerns. You continue to say that you have had dealings with my clients, which is, by your own admission, false. And you continue to imply that based on those dealings and other undisclosed facts, my clients have behaved in an unethical and inappropriate manner. Your prior false statements (for which you havc ncver issued any correction or apology) and your ongoing false statements continue to harm my clients' reputations and financial interests.

Your persistence in making fa1se and defamatory statements shows that you have no concern for the truth and have a spiteful agenda against my clients. I have reached out to you in hopes that you would stop making these statements and have received evasive non-responses. Indeed. you have failed to stop making these statements and have received evasive non-responses. Indeed, you have failed to explain in any manner the purported basis, if any, for your false statements, precluding me from even addressing whatever it is that makes you believe that my clients have acted unethically and inappropriately.

I again demand that you remove the false and defamatory statements from your website and any other publications immediately. Most importantly, I demand that you remove any express or implied
statement that you have had personal experiences with my clients as well as any reference to Mr. Arader personally.

Mr. Clothier makes some pretty wild twisted allegations about what I actually wrote. This only serves to inflame the matter and please his clients

Based on the above, I would NOT RECOMMEND doing business with W. Graham Arader III.
